terms and conditions

  1. South East Melbourne Phoenix Hospitality Package
    In this Agreement the South East Melbourne Phoenix Corporate Hospitality Package means the hospitality package supplied by South East Melbourne Phoenix to the Client on each match day, which includes admission to a game, the supply of a ticket and other benefits as noted by South East Melbourne Phoenix.
  2. Payment
    1. Payment is to be made as per the chosen payment option.
    2. Payment is immediately due and payable upon submission of a completed, signed and dated Corporate Hospitality Booking Form.
  3. Cancellation
    1. All cancellations must be in writing.
    2. If the purchase of the South East Melbourne Phoenix Corporate Hospitality Package is cancelled by the Client 7 or more days prior to the relevant game, the following refund policy will apply: a) 100% refund of payments should the South East Melbourne Phoenix Corporate Hospitality Package be on sold by South East Melbourne Phoenix; or b) 50% refund of payment should the South East Melbourne Phoenix be unable to on sell the South East Melbourne Phoenix Corporate Hospitality Package, despite reasonable efforts of South East Melbourne Phoenix to on sell the package.
    3. If the purchase of the South East Melbourne Phoenix Corporate Hospitality Package is cancelled less than 7 days prior to the relevant game, the Client will not be entitled to a refund.
    4. South East Melbourne Phoenix may cancel the South East Melbourne Phoenix Corporate Hospitality Package without notice if you are in material breach of any provision of the Agreement.
    5. South East Melbourne Phoenix will not be liable for any loss or damage arising out of the cancellation of the South East Melbourne Phoenix Corporate Hospitality Package pursuant to clause 3.4.
  4. Indemnity
    The Client will indemnify South East Melbourne Phoenix against any loss or property damage arising out of the Client’s use of the South East Melbourne Phoenix Corporate Hospitality Package and for any personal injury, death or loss or damage to any property or any person arising out of or as a consequence of your use of the facility or services except where such loss, damage, injury or death arises from negligent act or the omission of South East Melbourne Phoenix.
  5. Distribution of the Hospitality Package
    South East Melbourne Phoenix will distribute tickets, hospitality passes (if required) and other information to the Client approximately 14 days prior to the relevant game provided full payment has been received. Season Corporate Hospitality holders will receive their hospitality passes and relevant information approximately 2 weeks prior to the season start unless ordered within this period at which time South East Melbourne Phoenix will provide an alternate distribution method.
  6. General Conditions
    1. Client must ensure that each of its guests and ticket holders:
      1. does not act inappropriately (for example by making undue noise, being intoxicated, causing a disturbance or behaving in an offensive manner), as determined by South East Melbourne Phoenix in its sole discretion, at South East Melbourne Phoenix venues;
      2. do not erect, fix or display any goods, materials, advertisements or promotional material in, on or around the game day facility, without the prior written consent of South East Melbourne Phoenix;
      3. comply with all reasonable directions given by South East Melbourne Phoenix and the game day facility from time to time (and obligations referred to in the Privacy clause below);
      4. comply with all ticket conditions specified on tickets issued as part of the South East Melbourne Phoenix Corporate Hospitality Package; and
      5. do not use the South East Melbourne Phoenix Corporate Hospitality Package for any purpose other than that for which it was sold. Without limiting the generality of the foregoing, it is a condition of sale that any South East Melbourne Phoenix Corporate Hospitality Package or part thereof will not be re-sold, on sold, sublet or rehired nor used for advertising, promotion or other commercial purposes (including competitions or trade promotions) or to enhance the demand for other goods or services, without the prior written consent of South East Melbourne Phoenix.
    2. Any breach of this clause may result in the ticket holders being evicted from the South East Melbourne Phoenix venue and may result in the cancellation of the existing South East Melbourne Phoenix Corporate Hospitality Package without a refund, as decided by the South East Melbourne Phoenix in its absolute discretion.
